TradingByrd provides access to custom TradingView indicators on a subscription basis. By subscribing, you agree to the following:

• Indicators are licensed, not sold. You receive a non-exclusive, non-transferable right to use the indicators for personal trading purposes only.
• You may not redistribute, resell, reverse-engineer, or share indicator access with third parties.
• Access is granted via TradingView invite. You must have a TradingView account to receive indicator access.
• We reserve the right to revoke access for violation of these terms without refund.

Subscription fees are billed in advance on a recurring basis as described at the time of purchase. You may cancel your subscription at any time through your account or by contacting us.

Coaching sessions are educational in nature. Our coaches provide trading concepts, chart analysis techniques, and strategy frameworks — they do not provide personalized investment advice, trade recommendations, or financial planning.

Coaching fees are non-refundable unless otherwise stated at the time of purchase. Sessions must be scheduled and attended within the agreed timeframe. Missed sessions without 24-hour notice may be forfeited.

All coaching sessions may be recorded for quality purposes. By participating, you consent to such recording. Recordings are for internal use only and are not shared publicly.

You agree not to:

• Use the Website or services for any unlawful purpose
• Attempt to gain unauthorized access to any part of the Website
• Interfere with or disrupt the Website's operation
• Share, copy, or redistribute indicator scripts or proprietary materials
• Use the Website to transmit spam, malware, or harmful code
• Misrepresent your identity or affiliation
• Harass, abuse, or harm other users or our staff

All content on the Website — including but not limited to indicator scripts, educational materials, videos, text, graphics, logos, and software — is the exclusive property of TradingByrd and is protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise use any content from the Website without our prior written consent.

"TradingByrd" and related logos are trademarks of TradingByrd. All other trademarks are the property of their respective owners.

The Website and all services are provided "as is" and "as available" without warranties of any kind, either express or implied. To the fullest extent permitted by law, TradingByrd disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Website will be uninterrupted, error-free, or free of viruses or harmful components. We do not guarantee the accuracy, completeness, or reliability of any information provided.

TradingByrd is not a registered investment advisor. Nothing on this Website constitutes financial advice, investment advice, trading advice, or a solicitation to buy or sell any financial instrument.

To the maximum extent permitted by applicable law, TradingByrd, its owners, employees, contractors, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including but not limited to loss of profits, trading losses, data loss, or business interruption — arising from your use of the Website or services.

In no event shall TradingByrd's total liability to you for all claims exceed the amount you paid to TradingByrd in the twelve (12) months preceding the claim. Some jurisdictions do not allow the exclusion or limitation of liability, so the above may not apply to you.

You acknowledge that trading involves substantial risk of loss and that TradingByrd shall not be responsible for any trading losses you incur — whether using our indicators, following our educational content, or acting on information from coaching sessions.

Indicator subscriptions may be cancelled at any time. Upon cancellation, access will continue until the end of the current billing period. We do not provide pro-rated refunds for partial periods unless otherwise stated.

Coaching session refunds are handled on a case-by-case basis. If you are unsatisfied with a coaching session, please contact us within 48 hours of the session to discuss your concerns.

Chargebacks filed without first contacting us to resolve the issue may result in immediate termination of all services and a permanent ban from future purchases.

We reserve the right to terminate or suspend your access to the Website and services at any time, with or without cause, and with or without notice. Grounds for termination include but are not limited to: violation of these terms, fraudulent activity, chargebacks without cause, or any conduct we deem harmful to our business or other users.

Upon termination, your right to access the Website and use our services will cease immediately. Provisions of these terms that by their nature should survive termination shall survive, including intellectual property rights, disclaimers, and limitations of liability.
